These Terms of Service (“Terms”) govern your access to and use of SureFeedback Cloud, a visual feedback and collaboration SaaS platform operated by Brainstorm Force US LLC.

By accessing or using SureFeedback Cloud, you agree to be bound by these Terms. If you do not agree, you must not use the service.

Scope of These Terms

These Terms apply only to SureFeedback Cloud (SaaS platform), available at:

https://app.surefeedback.com

For transparency, SureFeedback also offers WordPress plugins that may integrate with the Cloud service:

These Terms only when connected to SureFeedback Cloud

Eligibility & Account Registration

Eligibility

To use SureFeedback Cloud, you must:

Be at least 18 years old, or have parental/legal guardian consent
Have the legal capacity to enter a binding agreement
Not be prohibited by law from using SaaS services

Account Creation

You must provide:

A valid email address (unique identifier)
Accurate personal or business information
A secure password

You are responsible for maintaining the accuracy of your account information.

Account Security & Access

You are responsible for safeguarding your login credentials
One account per individual (unless using a team plan)
You must notify us immediately of any unauthorized access
You may not sell, share, or transfer your account

Brainstorm Force is not responsible for losses caused by compromised credentials.

SureFeedback Cloud Services

SureFeedback Cloud provides:

Visual feedback tools (screenshots, annotations, comments)
Team collaboration and workflows
Project and workspace management
Role-based access and permissions
Secure cloud hosting and infrastructure
API access (subject to plan limits)

We may add, modify, or remove features at any time to improve the service.

Acceptable Use Policy

You agree not to:

Use the service for unlawful purposes
Upload malicious code or harmful content
Interfere with platform security or availability
Abuse, harass, or spam other users
Attempt to reverse engineer or exploit the platform

Violation may result in suspension or termination without notice.

Subscriptions & Payments

Billing Model

SureFeedback Cloud is sold as an annual subscription
Subscriptions auto-renew annually unless cancelled
Payments are processed via Stripe or PayPal
Prices are listed on our website and may change

Auto-Renewal

Renewal occurs on the anniversary of purchase
You will receive advance renewal notifications
You must cancel before renewal to avoid charges

Refund & Cancellation Policy

14-Day Money-Back Guarantee

Full refunds available within 14 days of first purchase
Refunds do not apply to renewal payments
Refund requests must be sent to [email protected]

By requesting a refund:

Your account access will be terminated
You must stop using the service immediately

License & Intellectual Property

SaaS Platform

SureFeedback Cloud is proprietary software
You receive a revocable, non-exclusive, non-transferable license
No ownership rights are transferred

WordPress Plugins

Plugin source code is licensed under GNU GPL v2
Cloud services, APIs, and premium features are not GPL

User Content & Data

You retain ownership of your content
You grant us a limited license to process content solely to provide the service
You are responsible for the legality of your content

We reserve the right to remove content that violates these Terms or the law.

Data Protection & Privacy

Use of SureFeedback Cloud is governed by our Privacy Policy:

Service Availability

Target uptime: 99.9%
Scheduled maintenance may occur
Emergency maintenance may be performed without notice

We do not guarantee uninterrupted or error-free service.

Support & Customer Service

Support is available only for active subscriptions.

Email-based support
Documentation and knowledge base
Priority support for higher plans

Expired or refunded accounts are not eligible for support.

Termination

By You

You may cancel anytime before renewal
Access continues until end of billing period

By Us

We may suspend or terminate accounts for:

Terms violations
Fraud or abuse
Non-payment

Termination does not entitle you to a refund outside stated policy.

Disclaimer of Warranties

SureFeedback Cloud is provided “as is” and “as available.”

We disclaim all warranties, including:

Fitness for a particular purpose
Non-infringement
Error-free operation

Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect or consequential damages
Total liability is limited to the amount paid in the last 12 months

Indemnification

You agree to indemnify and hold harmless Brainstorm Force from claims arising from:

Your misuse of the service
Violation of these Terms
Infringement of third-party rights

Changes to These Terms

We may update these Terms periodically.

Material changes will be communicated
Continued use means acceptance
You may terminate if you disagree

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the state or federal courts located in the State of Delaware, unless applicable consumer protection laws require otherwise.
